Mediation
Mediation is NOT a substitute for divorce.
Many couples misunderstand mediation as an alternative to normal divorce proceedings. This is not the case. Mediation benefits couples who simply cannot come to an agreement concerning the division of assets, debts, child custody, and other issues in their marriage. Mediation is an additional process prior to the commencement of or during divorce proceedings.
Mediation is a process where couples negotiate an acceptable agreement with the aid of a mediator. The mediator drafts a Memorandum of Understanding which, in turn, will be converted into a Marital Settlement Agreement.
If I am engaged to act as a mediator for both parties, I cannot represent either party in the divorce.
If I am engaged as an attorney to represent a party in a divorce, I can only represent that party. I can, however, draft your mutual agreement which your spouse can bring to a lawyer for representation or review.
